Living Painting - Terms of Service
1. What the service is
You send a photo of a painting you own. We make a "living picture" from it - an animated page in which the light follows the time of day, the seasons turn and the weather changes - using an AI studio guided by our own method, and place it in a private online library. The Living Frame app downloads your pictures to a tablet and plays them like a picture frame. The pictures work offline once downloaded.
2. Your account
A library is tied to one email address and opened with a code sent to it. Keep that mailbox safe: anyone who can read it can open your library. You must be 18 or older. One person, one library; you may not share a library with people outside your household or resell what it holds.
3. What you may send
- Only paintings you own or have the right to reproduce - your own, your family's, or ones whose owner has agreed. You are responsible for that right.
- Nothing unlawful, hateful, sexual, or that shows or targets a real person without their consent.
- Paintings, not photographs of places or people: the service is made for painted scenes, and we may decline a submission that is not one.
We may remove content and close a library that breaks these rules. If a submission is declined, its credit is returned.
4. What we make, and who owns it
Your photo stays yours. The living picture we make from it is yours to keep, play and share for personal, non-commercial use; you may not sell it or the method behind it. The instructions, software and working method that make living pictures are ours. We may keep, if you allow it, the working files behind an accepted picture - the outlines and settings, never your photo - as an example the studio learns from; you can switch that off in Settings at any time and existing examples from your library are removed (see the Privacy Policy, section 4).
5. Made with AI - what to expect
Living pictures are made by an AI studio following our method, and by you: you preview each draft, say what should change, and accept the one you want. The AI does not always get it right the first time. Some things are deliberately not done - people and animals in the painting are never made to move, and we will tell you plainly when something you ask for is not available. If the studio cannot finish a picture to a reasonable standard, or you ask for help, a person finishes it by hand at no extra charge. Because the result depends on the painting and on your own choices, we do not promise a particular look.
6. Prices, plans and credits
- The app is bought once from the app store at the listed price.
- The library plan is a monthly subscription (listed price in the store) that keeps your online library open and lets you send paintings. Cancel any time in the store; the library stays open until the end of the paid period. A library with no active plan is kept for one year and then removed, with an email warning first; pictures already downloaded to your tablet stay on the tablet.
- A painting submission is a one-time purchase (listed price in the store) that gives one credit. One credit is used when you send a painting. Each submission comes with an allowance of AI work; the app shows how much is left as a percentage. Rounds you ask for ("Say what should change") spend from that allowance. When it is used up, you may accept any draft that was made, or ask for help and a person finishes it - no further charge.
- All payment is taken by the app store (Amazon, Google or Apple) under its own terms. Prices include the store's fee and may change; a change never affects a purchase already made. Taxes are as the store applies them.
7. Refunds
Refunds for purchases made through an app store are requested from that store under its policy. We will return a credit ourselves when we decline a submission, when a technical fault on our side stops a painting from being made, or when you ask for help and we cannot finish it. A credit that was used to make a picture you accepted is not refundable.
8. Ending things
You can delete your library at any time, in the app or at naedash.com/living-painting-delete.html; everything in it goes, immediately and for good. We may close a library that breaks these terms, or stop the service altogether with at least 30 days' notice, in which case you keep any pictures you have downloaded.
9. Availability and changes
We aim to keep the service running but do not promise it will always be available; a painting is normally ready within an hour but may take longer. We may change the app and the service; if a change matters to what you have paid for, we will tell you in the app first.
10. Limits of our responsibility
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for anything arising from the service is limited to what you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
11. Law and disputes
These terms are governed by the laws of Washington, United States, and any dispute will be heard in the courts of Douglas County, Washington. If part of these terms is found unenforceable, the rest still applies.
